Health, HIPAA & Legal Notice

1. Important medical disclaimer

ClanCare is a consumer family coordination tool. It helps users organize information and communicate with family members about care. It does not provide medical advice, diagnosis, treatment recommendations, medication verification, clinical records, emergency monitoring, or guarantees about any user-entered information.

Always seek advice from a qualified healthcare professional for medical questions and independently verify medication, appointment and care information. In an emergency, contact your local emergency services immediately.

2. HIPAA position for consumer use

ClanCare is designed for direct-to-consumer family care coordination. On that basis, ClanCare is not acting as a HIPAA Covered Entity or Business Associate in its relationship with individual consumer users. HIPAA therefore does not automatically govern all information a consumer chooses to place in a personal account.

That position does not mean health-related information lacks protection. Other laws may apply depending on the user, data and jurisdiction, including state consumer-health-data laws and, where applicable, European privacy law. Our commitments are described in the Privacy Notice and the separate Consumer Health Data Privacy Policy.

ClanCare does not currently offer Business Associate Agreements and is not represented as a HIPAA-compliant service for healthcare providers or covered entities. Healthcare organizations should not use ClanCare for regulated clinical workflows unless and until they independently determine that it meets all obligations applicable to them and a written agreement is in place where required.

3. Data-security approach

ClanCare uses Firebase / Google Cloud for core infrastructure, authentication, database and storage; Firebase Crashlytics for reliability diagnostics; RevenueCat for subscription entitlement management; Resend for transactional email; and Apple App Store or Google Play for in-app purchase processing. We use reasonable safeguards designed to protect information, including access controls and encryption in transit and at rest where supported by provider configuration.

Access to care information is designed to be limited to the account holder and authorized family-group members. You are responsible for keeping credentials confidential and for inviting only people who should have access. No online service can guarantee absolute security, and we do not make such a guarantee.

4. Care recipient data and permitted use

Before adding another person’s health or care information, the user must have legal authority or that person’s explicit consent. The app requires a confirmation of that authority or consent before a care recipient profile is created or materially updated. Users remain responsible for the accuracy, legality and appropriate sharing of the information they add.

5. Intellectual property

The ClanCare name, logos, website design, application design, source code, text and other content are protected by applicable intellectual-property laws and belong to Angelo Cutrona or the relevant rights holder. Except as allowed by law or with prior written permission, you may not reproduce, distribute, modify, publicly display, commercially exploit, or create derivative works from ClanCare materials.

6. Additional legal terms

Your use of ClanCare is governed by the Terms of Service. The Terms contain provisions about the Service, subscription management, account deletion, disclaimers, limitations and governing law. Nothing in this notice limits a right that cannot legally be limited under applicable consumer or privacy law.
