ClanCare Inc. ("ClanCare", "we", "us", or "our") operates the ClanCare mobile application and website at clancareapp.com. We provide family care coordination services for families managing the care of aging relatives.

ClanCare is committed to protecting your personal data in compliance with applicable law including the California Consumer Privacy Act (CCPA/CPRA), and where applicable the General Data Protection Regulation (GDPR).

2. Data We Collect

Account data: Name, email address, password (hashed), and profile information you provide when creating an account.

Care data: Medication schedules, appointment records, care journal entries, family member information, and other care coordination data you voluntarily enter into the app. This information is entered by you for your personal family use.

Usage data: Device type, operating system, app version, session duration, and feature usage to improve our service.

Payment data: Payment processing is handled entirely by Stripe, Inc. We do not store your credit card details. We receive only subscription status and transaction identifiers.

Communication data: Any emails or messages you send to our support team.

Technical data: IP address, browser type, cookies and similar tracking technologies (with your consent where required).

3. How We Use Your Data

• To provide, maintain and improve the ClanCare service
• To process your subscription and send related communications
• To send service updates, security alerts, and support messages

5. Data Sharing

We share data only with trusted service providers acting as data processors under our instruction:

• Firebase (Google LLC): Database, authentication, and cloud infrastructure
• Stripe, Inc.: Payment processing
• Apple Inc. / Google LLC: App distribution (iOS and Android)

All subprocessors are bound by data processing agreements and are prohibited from using your data for their own purposes.

6. Data Retention

We retain your account and care data for as long as your account is active. Upon account deletion, your data is removed within 30 days from our production systems. Anonymized analytics data may be retained longer for aggregate analysis.

7. Your Rights

Depending on your location, you have the following rights:

• Access: Request a copy of your personal data
• Correction: Request correction of inaccurate data
• Deletion: Request deletion of your account and associated data
• Portability: Receive your data in a portable format

Your data is primarily stored on servers in the United States. If you are located in the European Economic Area, your data is transferred to the US under appropriate safeguards including Standard Contractual Clauses.

10. Security

We implement industry-standard security measures including encryption in transit (TLS), encryption at rest, access controls, and regular security reviews. While we strive to protect your data, no system is completely secure.

11. HIPAA Notice

ClanCare is a family coordination tool and is not a HIPAA-covered entity. The information you enter is personal family care data managed by you for your own family's use. We implement security practices aligned with HIPAA standards as a best practice, but we are not acting as a Business Associate under HIPAA.

12. Changes to This Policy

We may update this policy from time to time. We will notify you of material changes via email or app notification at least 14 days before they take effect.

By accessing or using ClanCare ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and ClanCare Inc.

2. Description of Service

ClanCare is a family care coordination platform that allows families to manage medication schedules, medical appointments, care journals, and family communication for the benefit of an aging relative or person in need of care.

3. Eligibility

You must be at least 18 years of age to use ClanCare. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

4. Accounts and Registration

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. You must notify us immediately at info@clancareapp.com of any unauthorized use of your account.

5. Subscriptions and Payments

Free Trial: We offer a 14-day free trial on the Premium plan. No credit card is required to start the trial. After the trial period, continued access requires a paid subscription.

Billing: Subscriptions are billed monthly on the date you subscribe. Payment is processed by Stripe, Inc. You authorize recurring charges to your payment method.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods, except as required by law or under our 30-day money-back guarantee for new subscribers.

30-Day Guarantee: New subscribers may request a full refund within 30 days of their first paid charge by contacting info@clancareapp.com.

Price Changes: We will provide at least 30 days notice before changing subscription prices.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Share your account credentials with unauthorized third parties
• Attempt to gain unauthorized access to our systems
• Upload harmful, illegal, or offensive content
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Use the Service to provide advice to others as a medical professional substitute

7. Medical Disclaimer

IMPORTANT: ClanCare is a coordination and organization tool for families. It is NOT a medical device, does not provide medical advice, and does not replace professional medical care. Medication reminders are organizational tools only — always follow your healthcare provider's instructions. In a medical emergency, call 911 immediately.

8. Intellectual Property

The Service, including all content, features, and functionality, is owned by ClanCare Inc. and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal family care coordination.

9. User Content

You retain ownership of all content you enter into ClanCare. You grant us a limited license to store and process your content solely to provide the Service. We will not access your family's care data except as necessary to provide and maintain the Service or as required by law.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLANCARE INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Termination

We may suspend or terminate your account for violation of these Terms, with or without notice. You may terminate your account at any time through account settings. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

14. Changes to Terms

We may update these Terms. We will notify you of material changes via email or app notification at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
